China's Legislative Process of the Protection for Business Secrets:Retrospect and Prospect

商业秘密保护立法的核心概念是竞业禁止;我国商业秘密保护立法进程起步于改革开放的社会转型时期,《反不正当竞争法》、《公司法》、《合伙企业法》、《个人独资企业法》、《劳动法》等五部相关法规,均各有一条角度不同的简单表述;越来越多的法商界专业人士趋于认同,应制订一部能全面反映竞业禁止立法精神、集中规定竞业禁止法律条款的专门法——《商业秘密法》。

Prohibition of business strifes is the key concept of the legislation in protecting business secrets.The process of this legislation in China started from a period of social transition with reform and opening up,with brief expressions each at a different point of view for the five related regulations,i.e.＂Law against Competition by Inappropriate Means＂,＂Law of Corporation＂, ＂Partnership Business Law＂,＂Law of Sole Proprietorship＂,＂Labor Law＂.More and more professionals of law and business tend to agree that it is essential to enact a special law-＂Business Secrets Act＂,which can fully reflect the legislative spirit in the prohibition of business strifes and commonly stipulate the legal provisions.
