论我国《反恐怖法》立法的基本原则

The Basic Principles of Formulating The Counter-Terrorism Law in China

依法惩治恐怖主义犯罪是维护我国国家安全、社会稳定大局的根本之策。我国《反恐怖法》立法,应坚持惩治"恐怖主义犯罪"入宪,明确"恐怖主义犯罪"核心概念,坚持刑法为主、民法与行政法为辅,不同类型规范并存,从严从重处罚,国际反恐合作,立法适度超前等基本原则,以有效地惩治恐怖主义犯罪。

To crack down on terrorist crimes in accordance with the law is the basic national policy in maintaing national safety and social stability.To effectively penalize terrorist crimes,the formulation of The Counter-Terrorism Law in China must insist on the principles of the inclusion of ’crack down on terrorist crime’ in the Constitution,clear definition of ’terrorist crime’,adhere nceto a comprehensive punishment with the Criminal Law as the main and the Civil Law and the Administrative Law as the subsidiary,severe and strict punishment of the crime,engagement in international cooperations,and moderate forwardness in legislation.
