风险社会视角下食品安全犯罪的立法缺憾与完善

我国已经步入了一个风险社会,风险社会的刑法必须顺应社会发展变化的要求作出内在变革。在风险社会的视角下,我国食品安全犯罪的"大一统立法模式"难以缓和立法安定性和灵活性之间的矛盾;刑事法网粗疏,不利于有效管控食品安全犯罪;刑罚介入时间迟缓,未树立食品安全犯罪的积极预防观念。为了更好地保护食品安全,必须对食品安全犯罪的立法缺憾进行相应完善。

Our country has already entered a risk society.Criminal law under risk society must make the internal transformation in response to the request of the social development and changes.Under the perspective of risk society,＂unified legislation mode＂ for food safety crime in our country is difficulty to ease the conflict between stability and flexibility in legislation.Gross criminal net is not conducive to the effective control of food safety crime.The intervening time delay,and not establish prevention concept.for food safety crime.In order to better protect food safety,we must accordingly improve the Legislative defects of food safety crime.
