民间法与农村社会的法治启蒙

Folk Law and Formative Education of Law in Rural Society

中国农村社会的法治化,固然离不开现代性法律制度的构建,但更取决于农村社会对于现代法治的普遍认同。这种内在的心理上的认同绝不可能通过外在制度的强制而生成,它需要我们在现实的社会生活中发现法律存在与发展的动因,在具体的生活场景中培育人们的信任情感。而作为农村社会生活经验积淀的民间法,体现了乡土社会人们对于生活的直接的规范性诉求,更容易受到人们的认同和遵守。依靠国家权威强制实施的正式的法律制度,只有积极地吸收民间法的合理成分,并通过对民间法的借鉴进行合法性重构,才能形成乡土社会对于现代法治的普遍信任。

Though the construction of modern legal system is important for the governing with law,widely acceptance to the modern law governing determines its realization in the rural society of China.The formation of such internal psychological acceptance can not be forced by external institutions.Emotion of trust will be cultivated when the driving force of the existence and development of laws is found in specific scenes of life.Folk laws are the accumulation of life experiences which can embody people＇s direct normative appeals and are easier to be accepted and abided by.Only by actively absorbing the rational elements of folk laws and making a legal reconstruction,could the enforcement of formal legal system achieve a widespread trust in rural society.
