摘要
中国水电工程顾问集团公司及其下属子公司对近年来在越南、老挝和缅甸水电工程中遇到的有关法律风险问题开展了专题研究,按照国务院国有资产管理委员会《中央企业全面风险管理指引》,对法律风险进行了收集、识别和评估。通过深入剖析,提出了相应的风险防控措施,初步形成了水电勘测设计企业在涉外水电开发建设中的法律风险管理基本路径和方法,为水电企业构建法律风险防范机制奠定了基础。
A specific research on legal risks has been carried out, which encountered in the design of hydropower projects in Vietnam, Laos and Myanmar by HydroChina Corporation and its subsidiary in recent years. Based on the requirements of Guidelines for Comprehensive Risk Management of State-owned Enterprises by the State-owned Assets Supervision and Administration Commission of the State Council, the legal risks are collected, identified and assessed, and the corresponding risk control measures are also proposed. These measures have initially constituted the basic ways and methods of legal risk management for Chinese hydropower survey and design enterprises participating in foreign hydropower development and provided a basis for building enterprise-wide legal risk management system.
