摘要
竞业限制制度是《劳动合同法》规定的重要内容。《劳动合同法》规定了竞业限制制度的适用主体、最长期限、经济补偿金和违约金。但需要明确的是,经济补偿金和违约金并不是竞业限制协议双方的核心利益所在,经济补偿金和违约金的数额亦可以不具有对等性。从实践中的案例来看,竞业限制制度有必要进一步予以完善。
The Prohibition of Business Strife is one of the important contents Of the Labor contract law. The Labor contract law provides for the Subject of application, the longest maturity, economic compensation and liquidated damages of the Prohibition of Business Strife. But we must make it to be clear that the economic compensation and liquidated damages are not the Core interests for the parties of the Non-competition agreement. From the practice of case to determine, The Prohibition of Business Strife is also necessary to be further improved.
