刑事立案监督的困境及破解——兼论立案监督的执法理念

Predicament and Solution of the Supervision of the Criminal Record——Concurrently Discuss the Law Enforcement Idea of the Supervision

从监督流程来看,刑事立案监督的困境主要体现在"二难",一是难以发现立案监督信息,二是难以开展有效监督。其中既有实践中被监督机关抵触的原因,又有立法不完善的因素。为解决这一问题,在立法层面应完善相关规范性文件,在实践层面应积极探索各种有效机制。应树立以下执法理念,即在监督范围方面,全面监督与重点监督并非一个层面的问题,既要全面监督,又要突出重点;在监督方式方面,应刚柔并济;在监督机制方面,介入式监督机制与分离式监督机制之间可同时适用。

In the terms of supervision process, there are two dilemmas for the supervision of the criminal record, the one is difficult to find the relevant information and the other is difficult to develop effectively. The major causes are the supervised organs collide in practice and the judicial practice not united. In order to solve this problem, we need to perfect the related regulated document on legislation and explore the el- fective mechanism in practice. We should set some the law enforcement ideas： from the range, the overall and key supervision belong to different layers they can woke together; from the way, we should be firm and flexible; from the mechanism, the invasive and separation supervision can be applied simultaneously.
