论遗失物拾得人的报酬请求权

The Rights of Reward claim of Finders of Lost Property

遗失物拾得制度的核心是返还遗失物。赋予拾得人报酬请求权不仅平衡了拾得人和遗失人之间的权利义务,而且还会有效地激励拾得人的返还热情,有利于保护遗失人的权利。我国法律应赋予拾得人报酬请求权,应规定报酬请求权的种类、报酬数额,并明确规定拾得人不享有同时履行抗辩权和留置权。

The core of the lost property finding system is the return of lost property. Giving finders of lost property the rights of reward claim can not only balance rights and obligations between finders and losers, but also encourage finders to return the lost property. That is beneficial to protecting the rights of losers. Our laws therefore should confer finders of lost property the rights of reward claim, and moreover prescribe its kinds and the amount of reward. It should be also definite prescribed that the finders have no defense right of simultaneous and lien.
