患者医疗知情同意权及其实现研究（三）——我国患者医疗知情同意权实现所存在的主要问题及对策研究

Research on Patients Informed Consent Right and Its Realization--Major Problems in the Realization of Patients＇ Informed Consent Right and the Countermeasures in China

目前，患者医疗知情同意权实现十分艰难，究其原因，主要体现在四个大的方面：一是来自于医学本身的专业性．这种专业性使绝大多数患者难以真正知情；二是因为医务人员存在不尊重患者知情同意权的情形或医务人员缺乏人文素养，很难有效告知；三是患者自身认知能力存在差异，在医务人员积极认真履行告知义务的情况下，部分患者也难以真正理解；四是知情同意权与保护性治疗之间缺乏平衡点。本文主要论述了在此背景之下，实现患者知情同意权的主要问题和解决措施。

Currently, it is very difficult to realize patients informed consent right, and there are four reasons： 1. the specialization in medicine itself makes it hard for most patients to be truly informed; 2. medical personnel doesn＇t respect the right of informed consent for patients, or medical staff are lack of humanities, which makes it difficult to inform effectively; 3. due to patients＂ differences in cognitive ability, it is difficult for them to really understand even when the medical staff earnestly perform their duty of informing; 4. there is no balance point between informed consent right and protective treatment. In this context, this paper mainly discusses major problems and the solution to the realization of the informed consent right for patients.
