当前医疗损害赔偿纠纷案件审理中存在的问题及对策研究

Study on the Problems in the Trial, of Current Medical Disputes for Damage Compensation and the Countermeasures

在当前医疗损害赔偿纠纷案件的审理中，存在着鉴定双轨制、法律适用-=-~L＇gc、病历的质证程序缺乏等问题。由于对法律的理解和认识不同，不同法官甚至是同一法院同一庭的不同法官在处理该类案件时也可能会采取截然相反的做法。笔者尝试对当前医疗损害赔偿纠纷案件审理中存在的问题进行剖析并提出相应对策，以期抛砖引玉，引起各界人士对此问题的重视并献计献策。

Currently, in the trial of medical disputes for damage compensation, there are some problems such as dual system in authentication, dualization of law application, and lack of cross-examine procedure, etc.. Differ- ent judges may have completely different judgement due to their different understanding and knowledge of the laws. In this paper, the author makes an attempts to analyze the problems in the trial of medical disputes for dam- age compensation and puts forward the countermeasures attention of oeoole from all fields and offering their ideas and suggestions.
