On the Power Control in the Modern Public Law——From the Prospective of Administrative Power Control

随着社会经济结构的变迁,社会分工的细化,人们之间的社会性联系更为紧密,对公共产品更为依赖,需要政府确实保障公共产品的不间断、高质量的提供,与此伴随的是政府职能的转变以及行政权力的不断膨胀与扩张。权力在可以整合资源为社会公共利益服务的同时本身也具有腐蚀性、扩张性、破坏性的负面特质,对权力的控制显得尤为重要。控权一直是行政法甚至是公法领域中的核心议题,在现有背景下研究对行政权力的控制有着重大的现实意义。

With changes in social and economic structure,the refinement of social division of labor,social contact among people is closer and more dependent on public goodness,so the government does need to protect the public goods of uninterrupted,high-quality provision.And the accompanying is the transformation of government functions and the continuous expansion of executive power.Power can integrate resources in the public interest,while it also has negative characteristics,such as corrosive,expansive,destructive.So power control is very important and the power control is a core issue in the field of administrative law.It has been always a core issue in the domain of administrative law and public law.In this context,research on the control of the executive power is of great practical significance.
