当前影响检察机关诉讼监督职能发挥作用的问题及改进措施

Research on Problems and Improvement of Affecting Functions of Prosecution's Supervision on Litigation at Present

司法实践中,检察机关的诉讼监督职能存在法律规定不完善、监督能力欠缺、监督形式不完备等问题,应从立法上、监督手段上、宣传力度上及考核机制等具体方面加以完善,推动诉讼监督的改革,从而保障诉讼活动合法、有序地进行。

In judicial practice,there are some problems in the functions of prosecution＇s supervision on litigation,such as imperfect legal provisions,being lack of supervisal capacity,incomplete supervision forms,and so on,which should be improved through legislation,supervision means,publicity efforts,and assessment mechanism so as to promote the reform of legal supervision and protect the litigation activities lawfully and orderly.
