我国机动车强制保险立法模式探究

我国涉及强制保险的两部立法之间的矛盾因冲突,导致了地方各自为政、司法实践中混乱局面的出现。应坚持现有的兼容机动车强制保险的立法模式,完善受害人直接请求权制度和道路交通事故救助基金制度。

The conflict between two laws on compulsory insurance in our country leads to local fragmentation and confusing judicial practice.We should stick to the current legislative model combined with compulsory insurance of motor vehicles and improve the system of victims＇ direct request right and the rescue fund system of road traffic accidents.
