On the Transition of Rule of Chinese Law in Effective History——A Sinicized Perspective

从效果历史的角度来看法治的发展过程,如果仅仅从历史的角度考察,只有历史考据学的分析,则法治的发展史会变成一部"死史",并不能为当代中国的法治进程提供更多的有意义的解读和借鉴。探究转型中国社会中的法治及其问题,应该先明白中国社会究竟是一个什么样的社会。中国的转型是马克思主义中国化的过程,是在一定程度上割裂了或清算了西方理论在中国自由生长的脉搏。作为解释者,必须从所在的不同于以往的环境、思维、地位、文化、经济、政治等出发,按照已有的"成见"作出处境和视域的融合。这些成见是"中国化"的成见。

To examine and analyze the development of rule of law,the perspective of effective history should by no means be confined to the historical perspective in general.Provided there is only retrospective analysis,the development of rule of law would turn to be a ＂dead history＂,which would provide the progress of rule of law for present China with rather limited interpretation and insightful reference.To probe into issues concerning rule of law in Chinese society during its course of transition,it should be understood what society it is in the first place.As a matter of fact,the transition of China witnessed a sinicization of Marxism,which cut off the free growth of some western theories to some extent.As an interpreter,one should make an analysis from circumstances of thinking,status,culture,economy and politics different from where he used to be,and integrate all those factors and perspectives according to his own ＂preconception＂ which mirrors the sinicization.
