Whose Tragedy is it——An Interpretation of Antigone Apart from Natural Law Theory

国内法学界对《安提戈涅》的解读大多将之作为自然法思想发端的例证,而忽略了剧本作者索福克勒斯所处的时代背景及其在创作时的指向与关怀。实质上,女主人公安提戈涅所言高于国王的法并非是自然法,而是神的意志,与自然正义的观念有很大的分别。更重要的是,该剧蕴含着深刻的对人类理性局限和自律可能的反思,反映出人类普遍的悲剧。

The Greek tragedy Antigone has been commonly interpreted in China as the classic example of nature law theory. The background of the author Sophocles and his concern have been ignored. The higher law referred by An- tigone is not natural law, but the will of God, which is very different from the notion of natural justice. More importantly, the play implies a reflection on the limitations of human reason and possibility of human self-discipline, which are the universal tragedy of human kind
