摘要
《侵权责任法》的核心精神就是保护民事主体的合法权益。在医患关系中,由于医务人员和患者具有平等的民事主体地位,那么在充分保障患者合法权益的同时,医务人员的合法益理权应受到保护,以要做到医患之间利益保护的平衡。本文试图从体现医务人员法律地位的权利与义务这两个方面探讨《侵权责任法》中"医疗损害责任"的相关规定对医患关系中医务人员法律地位的影响。
The core of Tort Liability Act is to protect the civil subjects＇legal rights.As the equal civil subject in relationship between doctors and patients,medical professionals＇legal rights should also be protected same as the patients to balance their interest.The influences of provisions of medical liability for damage in Tort Liability Act on medical professionals＇legal status were discussed in view of their rights and obligations.
