我国运动员人力资本产权制度构建研究

Property Institution Construction of Chinese Athletes Human Capital

针对目前我国体育界存在的关于运动员人力资本产权方面的争论焦点,运用人力资本理论、产权理论、新制度经济学的相关原理,深入研究我国运动员人力资本产权制度构建等问题。研究认为:我国运动员人力资本产权对于国家而言具有绝对的控制权,运动员人力资本产权总体上处于归属模糊、保护不力的状况。"归属清晰、权责明确、保护严格、流转顺畅"的运动员人力资本私有产权和共有产权并存的多元化产权制度,是市场经济条件下我国运动员人力资本产权制度建设的应然模式。

Starting from discussing focuses on athletes human capital property right that exist in our country sports field, using related theories, such as the theory of human capital, the theory of property fight, and the theory of New Institutional Economics, this dissertation probes into some important problems as property institution structure of Chinese athletes human capital. The result shows that our country has the complete control right to the human capital of the professional athletes, and the property right of athletes in our country has a blurred scale and weak protection in its operation. The property system of coexistence of the private and common property right of athletes with the characteristics of “clear belonging, exact responsibilities, strict protection and smooth operation” is the necessary pattern of the construction of property right of athletes in our country in market economy.
