摘要
我国台湾地区于2011年6月颁布了《金融消费者保护法》,以统合立法的方式原则规定了金融机构对金融消费者应负的义务,并对金融消费争议处理作了重点规定。本文从适用范围、消费者保护义务、争议处理机构和程序等方面介绍了台湾《金融消费者保护法》的内容,评析并揭示其对我国消费者保护立法的启示,提出了我国大陆金融消费者保护的框架性建议,包括完善金融消费者保护的法律体系,加强金融消费者保护的组织建设以及建立科学的金融消费者保护机制。
Taiwan promulgated the Financial Consumer Protection Act in June 2011,which regulates the financial institution's obligations to financial consumers in principle of unified legislation,and also focuses on disposal of financial consumer disputes.This paper introduces the main contents of that Act from the aspects of applicable domain,obligations for consumer protection,institutions and process for addressing disputes,comments on its implications for legislation of financial consumer protection act in China.It also raises some policy suggestions including improving legal system of financial consumer protection,strengthening establishment of its organizational structure and setting up a scientific financial consumer protection system.
