厌恶对道德和法律判断的影响

进化论的角度认为,厌恶起源于祖先避免接触可能会导致生病或者死亡的事物。厌恶分为核心厌恶和道德厌恶。研究者把个体从核心厌恶到道德厌恶的转变称之为厌恶的泛化。厌恶往往造成同情的减少和对异类群体的鄙视,它能使人的道德判断变得苛刻。本文通过例举前人的研究说明厌恶如何影响道德判断。并由此引发了对法律的三点启示:1法官的厌恶特质会影响对被告的审判。2被告的特征如贪婪会让法官对其更加厌恶。3被告如果被看作是外围人群就会激起审判人员的厌恶从而减少移情作用。

From the angle of evolutionary perspective,disgust originated from the ancestor to avoid exposure that may lead to illness or death thing.Disgust divided into the core disgust and the moral disgust.The phenomenon of the conversion from the core to the moral disgust.Researcher called it the generalization of disgust.Disgust had related to the reduction of Sympathy and the contempt of Heterogeneous group.It may lead to people＇s moral judgments become even harsh.By analyzing the achievements of others,the paper explained how disgust impacted the judgment of moral,and got three conclusions about the judgment of law.Firstly,the judge＇s disgust will affect the trial.Secondly,the characteristics such as greed of the defendant will increase the judge＇s disgust.Lastly,if the defendant was seen as the out group,then he or she would stimulate the judge＇s disgust,then reduce the effect of empathize.
