我国城管执法制度缺陷的根本原因在于基础理论研究上的落后。在行政行为形式理论影响下,通过"相对集中行政处罚权"将城管执法从完整的行政过程中剥离出来,最终使城市管理过程中累积的矛盾集中爆发。行政过程论的优势则在于注重行政政策的形成过程,强调人本主义的行政活动方式,以"过程和谐"带动"结果和谐"。

The root causes of defects of urban management enforcement systems are the backward basical theory research.Under the influence of the theory of administrative action form,with the relatively centralized administrative punishment power,urban management enforcement is spun off from the whole administrative process,eventually the accumulated conflicts in the urban management process break out together.The advantages of administrative process theory is focusing on the formation of administrative policies and emphasizing the humanistic administrative activities,with the harmonious process leading the harmonious results.
