摘要
时至今日,劳动合同法中劳动者的角色已从传统作为平等、自由和抽象的法律人格成功完成到具体的、事实不平等且自然应受倾斜保护的这一角色的转型。然而,这一看似为劳动者争取权益、谋求话语权的积极行为事实上,是建立在一种基于对人、商品和市场的理性认识前提下完成的,这种先天缺陷也必然给今天众多学者在对劳动合同法问题的范式研究上挖掘了一道无法逾越的鸿沟。基于该疑惑和思考,文章对如何看待及怎样正确处理劳动合同法所贯穿的理性主义、客观认知和社会实践中劳动合同主体非理性主义的应然存在这一问题进行尝试研究。
Now,the role of labor in PRC Labor Contract Law has transited successfully from equality,freedom and abstract moral integrity to concrete,inequality in fact and unilateral protection as impacted by social law.However,the like positive behavior which striving benefit and Discourse right for labor is founded on the rational recognition to Human being,goods and market,which dug out a wide gap for researchers on the Labor Contract Law Paradigm.Based on the thinkingabove,the article tries to make a study of the relations between rationalism in the practice of labor body and irrationalism in Labor Contract Law.
