设置金融法庭或者金融法院的建议主要是基于提升法院对金融案件审理的专业性以及保障司法独立审判这两方面的考虑,然而推行这项制度改革过程中所可能导致的社会成本负担以及我们需要面对的各种外在的约束条件也是不应当被忽视的,金融案件审判的司法组织体系改革需要有一个更为全方位的观察视角。

The suggestion of setting up financial tribunal or financial court is out of the consideration that the court should be more professional in financial case trials and the independence of adjudication should be secured.However,social costs resulting from the promoting of system reform and all the exogenous restrictions are not negligible.To reform the judicial organization system of financial case trials,we need a more fully dimensioned viewing perspective.
