摘要
《物权法》第77条对于"住改商"作出了限制性规定,最高人民法院又制定了《关于审理建筑物区分所有权纠纷案件具体应用法律若干问题的解释》对该限制做了进一步的补充。该条显示出公法以国家公共利益和社会共同生活利益为目的限制业主专有权,更显示出私法规范和相邻关系制度对业主专有权的限制。但是这种限制是有限度的,应在司法实践中把握有限度的限制尺度。
Article 77 of Property Law made the restrictive provisions for "changing the residential building to commercial use",and the Supreme Court formulated the "Trial of condominium ownership disputes a number of issues specific application of the law interpretation" for additional restrictions. They showed that the public law for the purpose of the national public interests and social interests of the common life of the owners set limitation to the exclusive rights of home owners. Furthermore,they showed restrictions from the system of private norms and adjacency restrictions on the exclusive rights of home owners. But there are limits to these restrictions.
