陕西民用航天产业知识产权保护问题研究

Research on Intellectual Property Protection of Civil Aviation Industry in Shaanxi Province

航天产业是当今世界最具挑战性和广泛带动性的高技术产业之一,它关系到一个国家国防的安全和经济的发展。随着我国国防工业引入了竞争机制和航天产业市场化改革的快速发展,航天产业特别是民用航天产业知识产权保护的重要性日显突出,知识产权已经成为一个越来越受关注的问题。文章通过研究国外民用航天产业知识产权的保护经验,进而深入分析了陕西民用航天产业知识产权保护的现状及存在的问题,最后提出陕西民用航天产业知识产权保护的对策和建议:从宏观上看,特别要完善我国国防知识产权方面的法律制度;从微观上看,要使民用航天企业成为知识产权保护的主体。

Aerospace industry is one of high and new technology industries that is the world＇s most challenging and widely driving,which is related to a national defense security and economic development.With China＇s national defense industry introducting the competition mechanism and the marketization reform of aerospace industry rapidly,the importance of intellectual property protection of aerospace industry especially civil aviation industry is more and more outstanding,intellectual property rights has become a growing concern.This article studies the experience of the protection of intellectual property rights that come from foreign civil aviation industries,then analyzes the present situation and existing problems of the intellectual property protection of civil aviation industry in Shaanxi province,finally we puts forward some measures and suggestions of how to protect the intellectual property rights of civil aviation industry in Shaanxi province,such as perfecting the leagle system of the intellectual property of civil aviation and making the civil aviation enterprise became the subject of intellectual property protection.
