摘要
行政裁量自我规制是行政主体及其工作人员基于自律、自行规范行政裁量行为、避免行政裁量权滥用、保障授权法目的实现的机制。行政裁量自我规制相对于行政外部规制而言,具有针对性强、效率较高和成本较低的优势。行政裁量自我规制的主要方式有法的精神、法的基本原则、正当法律程序、行政惯例、行政政策、裁量基准等。行政裁量自我规制的适用必须适当和适度。应该正确处理防止裁量权滥用与促进裁量权有效行使的关系,加强、完善自我规制与主动、积极接受外部规制的关系,健全硬法规制与推进软法规制的关系。
The self-regulation of administrative discretion is the mechanism for the administrative body and its staff to guarantee their administrative discretion behavior self-regulation, administrative discretion power abuse avoidance and authorization act purpose realization, which is prior to the external regulation in aspects of stronger pertinence, higher efficiency and lower cost. Although it has many methods such as spirit of law, basic principles of law, due process of law, administrative practices, administrative policies, discretionary basis, etc., the application of all these must be adequate and appropriate, in order to healthily handle the relations between discretion power abuse avoidance and effective exercise promotion, self-regulation strengthen and perfection and external regulations active acceptation, hard law regulations improvement and soft law regulations advancement, etc.
