论彝族婚姻中的身价费及其法律调适

彝族是中华民族最古老的民族之一,彝族文化为我国社会文化的多元化做出了巨大的贡献。其中婚姻文化是彝族文化的一大亮点,确有可圈可点之处,但也存在一些问题,其中身价费问题是核心,实质上买卖婚是私有制社会形态的产物,而身价费是买卖婚的重要标志。自从民主改革以来,特别是改革开放以来彝区社会形态已实现了历史性的飞跃,而彝族婚姻却没有走出买卖婚姻这个误区。彝区婚姻中的这种身价费与我国《婚姻法》有着诸多的冲突,应对其进行改良,使其朝着与现行法律相融合的方向演化。

Yi nationality is one of the oldest nation in China,and Yi culture made tremendous contribution to Chinese culture diversity.Of all marriage culture is a highlight of Yi culture,and indeed there are some questions.And marriage stats fee is the essence,and marriage is the product of private society,while marriage fee is an important symbol of trading marriage.Since the reform and opening up,the social form in Yi area has got historical leap,however,Yi marriage did not run out of this misunderstanding.The marriage fee in Yi marriage is of great conflict with Chinese marriage law,and we should reform it and enable it to evolve towards the modern law.
