摘要
禁反言是英国普通法的独特内容,是英国法律体系中一项极为复杂而又非常重要的法律原则,其目的在于维护公平与正义之自然法则。目前我国学界对此缺乏深入而系统的研究。为了完善诚实信用原则,我国应当研究并借鉴禁反言原则。
The doctrine of Estoppel is unique in English common law.It is an extremely complicated and important principle in the English legal system which is aimed to maintain the natural rules for equity and justice.Presently,in-depth and systematic research of the doctrine is lack in China.It is argued that China legal community should undertake researches of and reference to Estoppel to promote the Principle of Honesty and Credibility.
