专利的本质是一个权利束,交易则是一个经济学概念,包括市场型交易、管理型交易、政治型交易。通常意义上,专利交易是指平等主体之间的市场型专利交易,以转移专利使用价值为核心的专利转让、专利许可、专利信托等为主要内容。专利交易的外延较为丰富,按照不同的标准可以划分为不同的种类。专利交易具有显著的法律经济学属性。

The essence of patent is a bundle of rights. The transaction is an economic concept, including the market transaction, management transaction, political transaction. Usually, the patent trading refers to the market transaction between equal subjects, which the core is transferring the patent value, and the main content includes the transfer of patents, patent license, patent trust. Patent transaction extension is more abundant, according to the different standards which can be divided into different types. Patent transaction has significant law and economics attribute.
