警察权之法理基础,是以国家权力体系构架及其运行机制为核心内容的理论,为包括警察权恰制在内的基本属性定位研究奠定基础。权力制约思想发展出了密切相关、相映生辉的分权理论和宪政理论。这些理论在中国有学习借鉴的必要和基础,这些理论设计中的核心内容权力分立与权能制衡,为警察权基本属性的研究奠定了理论基础。

The Jurisprudence basis of the police power is the theory constructed on national authority and focuses on the operating mechanism of the authority system.It lays the foundation for the research on the positioning of the basic attributes including the police power properties.The ideological constraints of power resulted in the power decentralization theory and the constitutional theory,which are closely related and harmoniously complementary to each other.These theories are applicable in China and their core values on power decentralization and function balance set the theoretical basis for the research on the basic attribute of police power.
