立足于实体法的形式或实质犯罪分层标准存在缺陷,我国刑事强制措施体系呈现出相当的层次性梯度结构,是实然的犯罪分层程序性标准,是活着的犯罪分层,我国应倡导重罪、轻罪和轻微罪(微罪)的犯罪分层模式。

The formal or substantial standards based on substantive law for criminal typology is defective.The current criminal compulsory system has showed a hierarchical structure of gradient severity,which is the real procedural standard for alive criminal typology.A model for criminal typology comprised of felony,misdemeanor and minor offenses should be proposed accordingly.
