国内外政府信息公开法律体系比较研究

Comparative Study on the Legal Systems of Domestic and International Governmental Information Disclosure

专门的政府信息公开法可确保政府信息公开工作的顺利开展,但更需要与其他相关法律的良好配合以共同界定、处理政府信息公开过程中可能遇到的问题。在我国,目前与政府信息公开联系比较紧密的相关法律主要有《保密法》,《档案法》以及其他一些涉及到隐私方面的法律法规,本文将分析我国政府信息公开相关法律之间的兼容性,同时与美国、英国、澳大利亚、日、韩、新加坡等国的政府信息公开现状作比较分析,以对完善我国政府信息公开活动做进一步的参考。

Special legal systems of governmental information disclosure can ensure the disclosuring work smoothly,but there are more needs to cooperate with the other relevant legals to define,or dealing the possible problems which be encounted during the process of governmental information disclosure.In our country,currently,the relative laws which contact closely with the legal of governmental information disclosure is the ＂secrecy law＂,the ＂archives law＂ and some other laws and regulations which involves privacy.this paper will analyze compatibility among the relative laws of our governmental information disclosure,also,do a comparative study of legislative situation of the United States,Britain,Australia,Japan,Korea,Singapore and other countries to further perfect our country＇s governmental information disclosure.
