三网融合背景下著作权的法律保护

Legal Protection of Copyright under the Background of Triple Play

著作权法自诞生伊始就始终与科技进步保持着互动关系,三网融合意味着信息传播技术的再一次飞跃,不可避免地会在著作权领域掀起巨大波澜。在即将进入的三网融合时代,著作权人的权利进一步扩张,著作权保护范围得以拓展,授权价格大幅提高,同时也产生了新类型的侵权纠纷以及权利冲突。以三网融合的法律分析为基础,结合与之相关的著作权问题,提出相应建议,以期著作权制度在三网融合时代进一步得到完善。

From the very beginning of Copyright Law, it has always kept an interactive rela- tionship with scientific development. The birth of triple play means another breakthrough of infor- mation dissemination technology, which will inevitably exerts great influence on copyright. During the time when we will soon step into the era of triple play, the rights of copyright owners are ex- panded, and the protection range of copyright has been extended. This leads to the sharp price in- crease in licensing fee, and new types of infringement disputes and rights conflict. Based on the legal analysis of triple play, and taking copyright issues into consideration, some suggestions are provided by the authors with the purpose to perfect copyright system in the era of triple play.
