论中国与中亚经贸合作的法治问题及对策

On the Issue and Strategy of Law over Trade and Economic Cooperation between China and Central Asian Countries

制约中国与中亚五国开展经贸合作的法治"壁垒"主要是:法制不健全、执法不规范,贸易和投资壁垒、发展环境较差、企业税负较重、外国劳动力准入受限制、中国企业与员工面临人身与财产安全风险等问题仍然比较突出。推进中国与中亚国家加强经贸合作,完善争端解决机制,应重视加强中亚国家经贸法律制度的比较研究,加强双边或多边国家立法机关之间的沟通,积极提升为经贸合作服务的意识与能力;不断创新和完善相关法律制度,积极完善争端协调与规范机制;重视对国际经贸合作相关法律协调机制的效果分析,坚持从实际出发选择科学的方式方法,科学规范经贸合作行为,积极推进保护境外中国企业与员工人身与财产安全的工作走法治化之路,促进国际经贸合作科学发展。

Legal norm and control consistently underlie international trade and economic cooperation. Better sense of law is an im- portant measure and fundamental security for promotion of international trade and economic cooperation. The main legal＂barriers＂ that restrict the trade and economic cooperation between China and five central-Asian countries include： incomplete system of laws, irregular law-eriforcement, trade and investment barrier, poor development environment, heavier tax imposed On enterprises, restriction on access to foreign labour force, life and property safety hazard facing China＇s enterprises and staff. In facilitating the trade and economic coopera- tion between China and central-Asian countries and improving dispute-settlement mechanism, we should set emphasis on the compara- tive study in legal system on the trade and economy in central Asian countries, intensify bilateral or multi-lateral communication among legislative organs, enhance the sense and capability of serving for trade and economic cooperation; keep innovating and improving rele- vant law and systems; improve the mechanism of dispute coordination and norm; stress the result analysis of coordination mechanism in relevant law on international trade and economic cooperation. Besides we should choose scientific method from reality, subject trade and economic cooperation to scientific norm, protect on the law China＇s enterprises and staff＇s life and property safety and promote the ratio- nal development in international trade and economic cooperation.
