The Space Policy of Obama Government of the United States and Its Impact on International Space Law

美国奥巴马政府2010年6月28日发布的《美国国家空间政策》,明确了美国国家空间活动的基本原则、活动目标及相关方针。美国新空间政策不仅是美国现行国内空间立法的反映,也在表面上体现了美国政府对国际法的尊重。实际上,新的空间政策不仅对现行联合国框架下使用或威胁使用武力规则产生了严峻的挑战,也挑战了国际空间法中的国际合作原则。同时,其促进商业空间产业发展的政策也挑战了对WTO非歧视原则及现行WTO框架下反补贴制度。

National Space Policy of the United States which was issued by Obama government on June 23,2010 provided some fundamental principles ,aims and measures for national space activities. The new space policy conformed to its domestic law,and also apparently respected international law. Actually,the new space policy challenged the Rule on Using Force in the Framework of UN and the legal principle of international cooperationunder international space law and the principle of non-discrimination as well as legal systems on subsidies in the framework of WTO.
