民事诉讼视角下的农民工权益保护研究

加强和完善对农民工权益的法律保护是必要的。为了解决农民工权益的保护问题,应当取消农民工劳动争议案件仲裁前置的规定;应当扩大民事诉讼简易程序的适用范围,把农民工讨薪诉讼纳入民事诉讼简易程序。在涉及农民工的相关诉讼中,应当降低证据保全和财产保全的适用条件;应当实行举证责任倒置,在争议的案件事实最终真伪不明时,由雇主承担败诉的风险;应当建立帮助农民工追讨欠薪的检察长追缉制度;应当针对农民工完善欠薪支付令制度并建立农民工诉讼案件执行的绿色通道。

In order to protect peasant workers＇ rights and interests,we should cancel the arbitration pre-filter when peasent workers and employers have disputed.We should expand the scope of the summary proceeding of civil action.Peasant workers＇ litigation for chasing backsalary should be included in the scope of the summary proceeding of civil action.We should reduce the conditions of evidence preservation and property preservation.In the litigation we should reverse the burden of proof.In the case involving peasant workers,if the case facts are finally apocryphal,employers should bear the risk of losing.We should set up a system of public procurators whose task is chasing backsalary for peasant workers.We should perfect the system of wage payment order.We should establish green channel system that can help peasant workers win in civil procedure for execution.
