摘要
由于缺乏有效的规制评估工具,中国规制政策的制定不够科学,执行效果较差。如何有效引入在国外广泛采用的规制影响评估制度,以提高中国规制质量是急待研究的重要问题。中国引入规制影响评估制度的必要性在于它可以提高政府规制质量,同时也是规制改革的重要推动力量。可能性在于中国已经有了初步的理论研究和实践基础。实施框架构建的重点是制定本土化的"法律保障"、"实施指南"和"机构组建与职能分配"。
The lacking of effective regulation assessment tools leads to many inefficient and non-scientific regulation policies in China.This paper focuses on how to bring in the Regulation Impact Assessment(RIA) tool widely used in foreign countries in order to improve our regulation qualities.The necessity of bringing in the RIA tools lies on its improvement in government regulation quality,and it is also a main driving force to regulation reform.Its possibility lies on theoretical and practical basis we already have in China.The focal points are the localization of legal protects,RIA guidelines and setting up institutions and distributing obligations.
