中国体育社会团体自治权的法理研究

Study on the Legal Principle Issues of China's Sports Social Group

体育社团是由公民自愿组成,自主管理,为实现会员共同意愿,按照其章程以体育运动(或活动)为目的的非营利性社会组织,具有明显的自治性。其自治权主要源自法制环境下的于"契约自由"、法律规定,当然社团在主要包括申请设立、制定章程、组织工作、处罚、起诉、权利救济等方面内容还要受到法律的规制。现阶段,我国社会转型的进程中,体育社会团体的自治面临着自治行为合法合理原则的缺失、自治权外部配套机制不完善和体育社团自治权与政府规制的结合不规范等问题,需要从立法和体育管理体制改革等方面对其进行完善。

The sports social group,which has the obvious autonomy,is the non-profit corporation organized by person and the organizations voluntarily in a planned way for the execution of certain sports management function and the achievement of the specific sports objectives.The autonomy includes the management rights authorized by law,as well as the self-disciplined rights of management.The autonomy includes the application for the establishment,issuing the articles,right remedies,etc.At the present stage,China is undergoing social transformation.At this time,the sports social group is facing some problems,such as the inadequate legal and principle support,insufficient exterior supporting mechansim of autonomy and irregular combination between the sports social autonomy and government regulation.These issues shall be solved through legislation and reform of sports management system.
