中西方在家庭伦理观念、人际交往方式、人权自由观念等方面存在差异。法律没有能力创造文化中没有的东西,它总是与特定的社会和文化背景相联系。文化的多元性必然产生法律的多元性。问题的关键在于吸取何种西方文明,确切的答案是:在冲突与融合之后,以普世文明的胸怀,重建中国的价值。

There exist differences between China and Western World in domestic ethical ideas, communication styles and ideas of human rights and liberty. It is beyond the capacity of law, which is closely related to specific social and cultural contexts, to create what does not exist in the culture. Cultural diversity undoubtedly leads to legal diversity. The key problem lies in what western civilization should be absorbed, and the definite answer is to reestablish Chinese values with an open mind to common civilization.
