救助义务是一种侵权法上的作为义务,特殊关系是引起作为义务的重要根据。目前对恋人之间见危不救或见死不救需要承担法律责任的根源主要是先行行为,而对于无先行行为的恋人之间是否存在救助义务亟待法律对其适当性扩张。

The duty of rescue is an affirmative duty in tort law and a special relationship is an important issue for affirmative duties to happen.At present the root of legal liability for neglecting one＇s duty of rescue between lovers is advance behavior.Whether the duty of rescue remains between lovers without advance behavior depends on proper extension of current laws.
