好事者除外:公益诉讼原告资格标准

Meddler Except: Accuser's Standing in Public Interest Litigation

公益诉讼若采用"任何人"原告标准可能会导致公益诉讼的效果适得其反,还可能侵犯私人权益,对"私权自治"原则造成破坏。采用"好事者除外"原告标准可以较好地修正"任何人"原告标准的两大缺点。法院应推定每一个起诉者都非"好事者",一般应在庭审中结合被告提供的证据来决定起诉者是不是"好事者"。惟有在起诉者被法院认定为"好事者"的情形下,它才不具有原告资格。

In public interest litigation cases, if we use an ＂Any Person＂ test of standing, it may do more harm than good to public interest. It also may cause damage to private rights and deny individual autonomy in the enforcement of private rights, ＂Meddler Except＂ standing criterion can eliminate its two major disadvantages. Under a ＂Meddler Except＂ test of standing, any person should have standing to institute a proceeding unless the court is satisfied that the person is a meddler.
