非刑罚处理方法在刑事和解中有着重要的工具价值和功能价值。非刑罚处理方法的工具价值体现在承担加害人刑事责任、实现刑事和解功能和保证达成刑事和解三个方面。恢复被害人损害、促进加害人回归社会和修复社区关系是非刑罚处理方法在刑事和解中的功能价值。刑法中现有的非刑罚处理方法不能完全适用于刑事和解,应当以刑事和解中非刑罚处理方法的功能为导向,在现行刑法非刑罚处理方法体系之外构建适用于刑事和解的非刑罚处理方法新体系。

Non-penalty measures have important values as the tool and function in victim-offender mediation. The value of tool in victim offender mediation is shown by means of the criminal burden of the offender, function of victim-offender mediation and the achievement of victim offender mediation. Recovery of the victim＇ s damage, the offender＇ s social return and community relation repairing are the value of function in victim offender mediation. Non-penalty measures in the present criminal law is not so appropriate for victim-offender mediation practice, we should strive to construct new non-penalty measure system in victim offender mediation.
