This paper analyses the dispute that might occur during collision avoiding action taken by two vessels ap- proaching to be in sight of one another in restricted visibility, presents two different views of the collision avoiding action in the English court and the American court and finally discusses the collision avoiding rules that should be observed and the action taken by two vessels approaching to be in sight of one another in restricted visibility.
