法律视角下农村土地流转面临的困境与出路

本文在分析我国农村土地流转现状的基础上,探讨了法律视角下农村土地流转面临的困境与出路。我国现阶段农村土地流转有着鲜明的特点:全国缺乏统一的农村土地流转市场、农村土地流转的行为不规范、土地流转行为纠纷发生率高、区域差异大等现象突出。而我国农村土地流转面临的困境主要是农村土地大规模流转的条件不成熟、农村土地分布零散、土地流转过程中纠纷较多、缺乏土地流转的专门服务体系。应对上述问题可以通过农村土地流转形式的多样化、有关土地流转的法律制度体系化、农村土地产权改革深入化、促进农民就业机制多样化等途径寻求解决措施。

This analysis on the basis of the circulation of rural land in China,explores legal dilemma and outlet of rural land circulation in the view.China＇s rural land circulation has distinctive features： lack of unified national circulation of rural land market,nonstandard behaves of rural land circulation,high incidence of land transfer Act dispute,large regional differences in phenomena such as prominent.And difficulties of China＇s rural land circulation is mainly rural land conditions are not ripe for mass circulation,in the process of circulation of rural land distribution,land scattered disputes more specialized service system,lack of land.Can address these issues through the diversification of the forms of rural land circulation,circulation of the land legal system,reform of rural land property rights,the promotion of rural employment diversification of mechanisms,including seeking solutions.
