On the Formation of the New Kind of Administrative Legal Relationby the Right of Administrative Participation

参与式行政是当代公共行政兴起的新的行政模式,赋予行政相对人行政参与权是参与式行政的根本标志。行政参与权改变了行政法律关系主体双方地位,重构主体双方权利义务关系,转变了主体双方权利义务关系的目的,变化了主体双方权利义务的存在方式,形成了新型行政法律关系,亦即参与式行政法律关系。

A new model of administration such as the participatory administration is rising in contemporary public administration.Endowing the right of administrative participation to the administrative counterpart is the basic indicator of the participatory administration.The right of administrative participation changes the position,reconstructs the relation of rights and obligations,varies the purpose of rights and obligations,transforms the existence and implementation of rights and obligations of the main parties in administrative legal relation.And these form the new kind of administrative legal relation,which is the participatory administrative legal relation.
