改革农村土地征收制度 完善增值收益分配机制

Reform Rural Land Expropriation System and Perfect Increment Income Distribution Mechanisms

笔者从农用地转用的征收补偿和增值收益分配的现状、存在的问题和完善调控机制的迫切性,探讨相应的法律措施。由于转变经济发展方式、保障粮食和生态安全,实现可持续发展和保障农民合法权益的迫切需要严格界定公益性建设用地;公益性建设用地的征收、征用补偿标准,在按照被征收征用土地的原用途给予补偿的基础上适当调高;对经营性建设用地申请农用地转用的程序,应按照行政许可法的规定设定更为详尽的实施程序;建立经营性建设用地的增值收益分配机制和经营性建设用地的产权处理方式。

This article discusses the corresponding legal measures by analyzing rural farming land expropriation compensations and the increment income distribution,the existing problems and the emergency of perfecting the adjustment mechanisms.Firstly,we should strictly define public welfare construction land in order to transform economic development model,guarantee crop and ecological security,carry out sustainable development and protect the legal rights of peasants.Secondly,the acquisition of public welfare construction land and its compensations should be raised after compensations have been paid for the original use of expropriated land.Thirdly,more detailed procedures should be made about the application for commercial construction land according to administration permission laws.Last but not least,we should set up increment income distribution mechanisms and property management mechanisms for commercial construction land.the increased profit allocation
