由于各种原因,我国有限责任公司中隐名投资的现象比较多。对于隐名股东的存在,我国《公司法》既没有给出一个确定的标准,也没有对隐名股东作出否定的法律评价。如何正确评价隐名股东的法律地位,关乎隐名投资者权益的保护和市场主体的稳定。
Due to various reasons, dormant investment phenomenon in China＇s limited liability company is popular. For the existence of dormant shareholders, China＇s ＂company law＂ does not give its identification, nor provides a certain standard, or makes negative evaluation of the law on the dormant shareholders. How to correctly evaluate the dormant shareholder＇s legal status, concerns with the protection of the unnamed investors＇ rights and the market stability.
