被驱逐者的人权保护问题研究——以“关于保护被驱逐者人权的修订条款草案”为视角

Research on the Problem of Human Right Protection Concerning Deportee——The Perspective of the Revised Draft Articles on the Protection of Human Rights Deportees

长期以来,对外国人进行驱逐都是国家行使对外国人刑罚或处罚的一种手段。近些年来,由于恐怖主义的盛行、非正常移民问题猖獗以及国际迁徙问题,许多国家对外国人的驱逐行为越来越频繁,在驱逐的过程中不可避免地产生了对被驱逐者人权的侵害,如何保护被驱逐人的合法权益成为了国际社会面临的共同问题。本文从国际法委员会提出的"关于保护被驱逐者人权的修订条款草案"出发,通过结合国际人权条约中对被驱逐者人权的具体保护,对草案内容进行了分析,明确了国际社会对被驱逐者人权保护的发展趋势,并对我国今后完善被驱逐者的人权保护提出了相关的建议。

Over the years, the expulsion of aliens as a means of penalty or punishment is exercised by all countries. In recent yeas, due to the prevalence of terrorism, rampant of irregular migration issues, and international migration issues, many countries on the expulsion of aliens is becoming more frequent, unavoidable in the process of expulsion against the human rights of deportees. How to protect the legitimate rights and interests of deportees has become a common problem for the international community. From the International Law Commission on the revised draft articles on the protection of human rights of deportees, starting on the content of the draft were analyzed through a combination of the specific protection of international human rights treaties on the human rights of deportees, made clear the international community to be expelled trend of development in the protection of human rights, and our country will improve the protection of human rights of the deportees to the recommendations.
