建立健全行政补偿制度减少农村重复信访问题研究

Establishing an Administrative Compensation System to Reduce Repetitive Rural Letters & Visits

以黑龙江省农村信访案例为例,黑龙江省农村重复信访案件类型主要涉及农业问题、城郊或城镇拆迁安置问题、环境污染与生态破坏问题和侵害上访人利益的违法乱纪行为等与农民切身利益紧密相关的四个方面。建立健全行政补偿制度是减少农村重复信访问题的关键。黑龙江省应当建立并进一步完善行政补偿制度,在不与国家上位法相冲突的原则下,出台关于行政补偿的地方性法规,用地方性法规的形式规范行政补偿行为,以使这部分农村重复信访人员的权益得到适当补偿,从而达到息讼罢访的目的。

Analyzing cases in Heilongjiang, the author finds that the ease types of rural petition letters and visits involve four aspects which are closely related to the vital interests of farmers： agriculture, suburb or town relocation, environmental pollution and ecological damage, and the infringement of petitioner＇s rights violating laws and regulations. Setting up and perfecting an administrative compensation system is the key to reduce repetitive rural letters and visits. In this respect, Heilongjiang should build up and improve this system, issuing local regulations which do not conflict with the superior law to regulate administrative compensation conducts, to some extent, making up for petitioners＇ interests.
