涉外产品侵权责任法律适用的新发展

The New Development of the Application of Law on Foreign Product Liability

随着经济全球化、生产方式的革新和公众消费能力的不断提高,跨国界的产品责任案件呈现出新的特征:侵权行为的间接性;侵害行为的高科技性和复杂性;损害程度的深刻性及范围的广范性;侵害行为的多方参与性。而我国没有调整涉外产品责任的专门法律制度,此外关于涉外产品侵权责任的准据法过于简单和僵化,无法适应调整日趋复杂的涉外产品侵权法律关系的需要。因此,可借鉴国际上的通行做法以期完善我国的涉外产品侵权责任法律制度。

With the fast development of the economic globalization,the advancement of science and technology,the renovation of production style and the improvement of the public consumption ability,more and more dangers come into the public＇s routine lives.Therefore,some new characteristics are shown in the trans-territory cases on product liability,such as the indirect nature of tort,the high-tech and complicated nature of tort and so on.Till now,China has no regulation particularly regarding the application of law on foreign product liability while many developed countries have made special laws.So,China may refer to general rules and improve legal system on the application of law on foreign product liability.
