从行政法和经济法的原理分析政府干预房价的权力边界

摘要 由于我国城市人口众多,城市居民对住房的需求量极大,而房地产的建设周期和建设规模,无法充分满足住房需求,致使房价持续上涨。房地产市场的投机行为更加剧了房价过快上涨。政府作为宏观调控国民经济的主体,陆续出台了很多政策以稳定房价引导房地产业健康发展。由于政府调控房地产的政策越来越细致,越来越具体,因此有人认为政府的调控政策已超越宏观调控的范围。而实际上,政府宏观调控的范围在实施过程中是模糊的。从政府在房价调控中出现的问题出发,分析政府在调控房价方面的权力边界。 As the increase of our country's urban population,the demand for the housing increases.The real estate construction period and the scale of development can't meet the demand of housing.So the housing prices continue to rise.And the speculation in the property market exacerbates the overheating in housing prices.The government,as the main body of the macroeconomic regulation and control the national economy,has promulgated many policies to stable prices in order to lead the healthy development of real estate industry.Because the government regulation of real estate is more and more detailed and specific,people think that the government's control policy has beyond the scope of the macroeconomic regulation.In fact,the scope of the control of the government in the implementation process is fuzzy.The government's authority boundary in the intervention of house prices is analyzed from the perspective of the problems arises in the government's regulation of house prices.
